The class-action case centered on BofA’ collecting check overdraft and other fees by takingf moneyfrom direct-deposit accounts set up to receive Socialp Security benefits. In 2004, a jury found BofA’zs actions violated California banking laws that prohibit bankss from taking Social Security benefits to recovercustometr debts. But in 2006, the 1st Distric t Court of Appeal in San Francisco ruledBofA didn’t breach state banking laws. The appealws court said the lawsuit misapplied a 1974 Californiz Supreme Court decision that prohibitsw banks from using public funds depositedc into an account to pay thebank customer’s separate credit-cardx account.
Monday’s unanimous ruling uphelx that decision.
